{"id":8420,"date":"2024-03-26T00:44:00","date_gmt":"2024-03-26T03:44:00","guid":{"rendered":"https:\/\/ax.ar\/garantech\/?p=8420"},"modified":"2024-03-26T08:47:17","modified_gmt":"2024-03-26T11:47:17","slug":"regulacion-cripto-lo-que-hay-que-saber-del-registro-y-como-afecta-a-las-fintech","status":"publish","type":"post","link":"https:\/\/ax.ar\/garantech\/regulacion-cripto-lo-que-hay-que-saber-del-registro-y-como-afecta-a-las-fintech\/","title":{"rendered":"Regulaci\u00f3n cripto: Lo que hay que saber del registro y c\u00f3mo afecta a las fintech"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">El Gobierno Nacional cre\u00f3 el <strong>\u201cRegistro de Proveedores de Servicios de Activos Virtuales (PSAV)\u201d<\/strong> y requisitos para la identificaci\u00f3n y mitigaci\u00f3n de riesgos de lavado.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Se trata de un importante avance en la regulaci\u00f3n de empresas fintech que operan con Bitcoin y otras criptomonedas, tras a\u00f1os de grises normativos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adem\u00e1s, hab\u00eda sido una recomendaci\u00f3n del <strong>Grupo de Acci\u00f3n Financiera Internacional<\/strong>, que est\u00e1 evaluando a la Argentina en la lucha <strong>contra el lavado de dinero.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De acuerdo con la Resoluci\u00f3n General 994\/2024, publicada esta madrugada en el Bolet\u00edn Oficial, tanto las personas humanas como jur\u00eddicas que proveen en el pa\u00eds servicios relativos a criptomonedas deber\u00e1n inscribirse en el Registro de Proveedores de Servicios de Activos Virtuales (PSAV).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El plazo previsto ser\u00e1 de 45 d\u00edas; de no registrarse, no podr\u00e1n operar m\u00e1s en la Argentina.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El registro de proveedores <strong>no afectar\u00e1 a los usuarios<\/strong>, sino que las billeteras pasar\u00e1n a ser sujetos obligados, sometida a las obligaciones establecidas en las leyes de Prevenci\u00f3n de Lavado y Contra el Financiamiento del Terrorismo, para lo cual deber\u00e1n tener un registro de sus usuarios e informar a la Unidad de Informaci\u00f3n Financiera (UIF) si detecta la existencia de operaciones sospechosas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El registro comprende a todos quienes utilicen p\u00e1ginas web, redes sociales u otros medios, y que direccionen su oferta o publicidad a sujetos residentes en la Argentina.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Las <strong>empresas extranjeras ser\u00e1n alcanzadas solo las que tengan un volumen de negocios en el pa\u00eds que exceda el 20% de su volumen total <\/strong>o que utilicen cualquier tipo de tecnolog\u00eda que les permita recibir localmente fondos para operar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Quedar\u00e1n exceptuados de la obligaci\u00f3n del registro solo aquellas personas o empresas que no superen, de manera agregada, un monto equivalente a 35.000 UVA mensuales (hoy $26 millones o US$32.000 por mes).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En los pr\u00f3ximos meses, desde la CNV afirmaron que continuar\u00e1n con el proceso regulatorio y la determinaci\u00f3n de los par\u00e1metros y reg\u00edmenes informativos para la prestaci\u00f3n de servicios por parte de los Proveedores de Servicios de Activos Digitales.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Gobierno Nacional cre\u00f3 el \u201cRegistro de Proveedores de Servicios de Activos Virtuales (PSAV)\u201d y requisitos para la identificaci\u00f3n y mitigaci\u00f3n de riesgos de lavado.
